As stated by the victim's attorney, Aliya Arzymbetova, the criminal proceedings were halted twice, and this was done without waiting for the expert conclusions.
“We reviewed the case materials, which include orders to terminate the criminal proceedings. The case was closed twice, citing the absence of a crime. However, the prosecutor revoked these orders, and the investigation resumed. The victim's mother only learned about all this when reviewing the documents,” explained the attorney.
The situation has caught the attention of the Children's Rights Commissioner, Dinara Zakiyeva. She personally reached out to the schoolgirl's mother and offered assistance.
“She declined the help because they currently do not need it,” added Aliya Arzymbetova.
The police are investigating the case under part 4 of Article 120 of the Criminal Code of the Republic of Kazakhstan (“Rape committed by a group of individuals against a minor”). This is a serious crime that carries a harsh penalty, including life imprisonment.
Currently, psychologists are working with the victim. The girl's mother hopes that the case will be brought to court and that those responsible will face appropriate punishment.
